Exclusions and Limitations

These are some of the exclusions that apply to the policy.  There are further provisions such as those relating to under insurance as well as general conditions and exclusions.  Details of these can be found in the policy document.  Other additional terms and conditions may be applied in certain cases. Excesses apply to certain types of claim.

Property damage excludes:

  • Storm, theft, accidental/malicious damage, burst pipes, or sprinkler leakage in an unoccupied building. See policy condition 13 for terms and conditions
  • Theft of contents not involving forcible and violent entry to or exit from the premises, or to items in gardens or landscaped areas. See Event 11 of Section 1 for terms and conditions.
  • Storm, tempest or flood to fences, gates and property in the open. See Event 7 of Section 1 for terms and conditions.

Felt roof condition

You must ensure that any felt roof over seven years old is inspected annually and any remedial work required completed.  See Condition 3 of Section 1 for terms and conditions

Property Owner's liability excludes:

  • Asbestos - we will not be liable for legal liability in respect of injury loss or damage directly or indirectly caused by arising from in consequence of or in any way involving asbestos. Provided that this exclusion shall not apply to liability for injury or loss of or damage caused by any commodity article or thing containing asbestos where the presence of asbestos is not in itself a direct or indirect cause of such injury or loss or damage. 

Legal Expenses:

The following exclusions and limitations apply to landlords legal expenses cover:

Employment contract cover exclusions include:

  • disputes which occur within the first 3 months of cover.
  • disputes with an employee who was subject to a warning in the 6 months preceding the inception of this cover.
  • disputes over redundancy.
  • any dispute that you have not discussed with Lawphone before you take any action.
  • disputes involving sub-contracting or contracts for services with self-employed persons.
  • you are responsible for the first £1,750 of each claim

Property cover exclusions include:

  • claims relating to mining or subsidence.
  • you are responsible for the first £500 of each claim.

Prosecution Defence cover exclusions include:

  • allegations of dishonesty or intentional violence.
  • you are responsible for the first £500 of each claim.

Tax and VAT cover exclusions include:

  • representations during an in-depth investigation.
  • anything to do with an investigation by the Inland Revenue Special Investigation Section or Special Compliance Office.

Licence Protection cover exclusions include:

  • hearings arising out of any commercial decision made by you.
  • the first application for, or standard renewal of the licence.
  • anything to do with drug offences or under age drinking.
  • you are responsibile for the first £500 of each claim.

Personal injury cover exclusions include:

  • personal injury disputes between you and any employee(s).

Exclusions applicable to all covers include:

  • disputes over rent, business rates or service charges.
  • any injury, damage, prosecution or appeal relating to owning or using a motor vehicle.
  • disputes relating to share rights.
  • anything relating to franchise or distribution agreements.
  • any one claim limit £100,000. Period of insurance aggregate limit £500,000.
